What is the Roku/TCL lawsuit?
According to the top class actions reportPlaintiff Terry Ells recently filed suit in federal court in California. Else’s lawsuit claims software updates issued by Roku and TCL were “repeatedly flawed.” According to the suit, the updates make some TVs from both Roku and TCL “bricked” or otherwise unusable. The rest say these updates “materially impair” the functionality of Roku’s devices and that both companies failed to disclose the problems to consumers; Instead, that Roku and TCL sell these products as “reliable” smart TVs that “will continue to get better over time…thanks to (ongoing) automatic software updates.”
The lawsuit claims that Roku and TCL offer no recourse to customers whose TVs malfunction, despite warranties that claim to address software defects. Others try to represent a nationwide class action suit with a jury trial with a monetary award for all involved. I don’t have a Roku or TCL TV, so I can’t personally attest to the issues. However, there are over 300 comments on the Top Class Action report, with many (if not most) complaining of the same issues with their Roku TVs. “My TV turns off randomly and sometimes takes several attempts to turn on;” “It won’t play unless it’s connected to the internet and then a lot of stations have a blank screen,” “I just disposed of a 65″ Roku branded TV that went black less than 3 years after purchase.” Many comments simply request to be added to the class action suit.
As it happens, this case isn’t the only class action lawsuit Roku is facing at the moment: Another customer is suing Roku To remove the feature from its smart home camera and require a new subscription to reinstall it.
